HANSON CONSERVATION COMMISSION
MINUTES OF THE PUBLIC MEETING OF APRIL 29, 2015
TOWN HALL, 542 LIBERTY STREET, HANSON, MA

Called to Order at 7:00 PM under M.G.L. c 131, §40 and the Hanson By-Law 3-13, §5 and Rules and Regulations by John Kemmett, Chairman, in Meeting Room A at the Town Hall.

Appointment

7:30 PM  Appointment with Chip Muncey, Superintendant for the Water Department to discuss future planning of test holes for town wells – cancelled per request of Mr. Muncey

Public Hearings

7:00 PM   After the Fact Notice of Intent for the installation of a concrete pad and hot tub and a proposal to take down existing shed and replace with new shed within 100 feet of Resource Area which is West Monponsett Pond at 39 Ocean Ave., Map 2, Lot 1509 & 1510 for Brenna Audette.  (DEP #SE175-0660)  (New Hearing)

        Mr. Kirlin read the Public Hearing Notice and the abutters were verified.  Ms. Nehiley reminded the Commission that Ms. Audette had come in previously with a Request for Determination.  The Commission denied the Request and required that a Notice of Intent (NOI) be filed as the work had been done within the 50’ no touch zone.  The NOI was submitted to the Department of Environmental Protection and issued an identifying number.  The Natural Heritage of Endangered Species Program was also notified and had sent a letter confirming that the project had no impact to the environment.   Mr. Kemmett suggested that as mitigation for the disturbance within the 50’ buffer zone, a 5’ buffer strip be maintained at the water’s edge with a 4’ wide boat access.   No abutters were present.

7:15 PM  Abbreviated Notice of Resource Area Delineation to determine the accuracy of a Bordering Vegetated Wetland and a Mean Annual High-water Mark at 775 West Washington Street (Rear), Map 66, Lot 5A-1 for Glen Priolo represented by PRIME Engineering, Inc.  (DEP #SE175-0661)  (New Hearing)

        Mr. Kirlin read the Public Hearing Notice and the abutters were verified.  Ms. Nehiley commented that Mr. Delano, consultant for the Commission had submitted a Review Letter (dated 4/15/15) verifying the resource areas.  In his letter, he had suggested a modification to the wetland line for the BVW and a minor change to the River Bank line.  Otherwise, Mr. Delano found the line to be accurate and consistent with his observations in the field.  Mr. Priolo, who was present, had his Engineer make the changes and submit a revised Plan (dated 4/24/2015).  Mr. Kemmett asked if any abutters were present.  Those present were:

Susan Leahy, Holmes Street - Was concerned with how the high water table and the development of the property would have an effect on the area.  Mr. Priolo answered that they are subject to the Stormwater Management regulations and a retention pond will be proposed to handle excess runoff.  Mr. Kemmett added that a Notice of Intent for the project will include a Plan depicting the proposal and it will be reviewed at a future public hearing.
Robert Leahy, Holmes Street – Was concerned with the proximity of the development to the train tracks and the noise factor.

Discussions

Request for Certificate of Compliance for 61 Ocean Ave. Map 2 Lots 1506 & 1507 (DEP #SE175-0453) – tabled as nothing new was received from the applicant or engineer

License to Enter and Use a Portion of Land Located off of William Way (DEP #SE175-0647)  

Motion to approve the license as written that allows the use of the Licensed Premises for drainage of overflow storm water which was contemplated in a vote at the 10/6/2014 Special Town Meeting:  John Kemmett

1101 Main Street  -  Ms. Nehiley informed the Commission that the Zoning Board of Appeals had approved both projects proposed by Mr. Marangiello.  Mr. Kemmett suggested that that Mr. Kirlin come into the office to familiarize himself with the previous files for the project as the Commission has worked with Mr. Marangiello in the past and he will be coming in with a new Notice of Intent.  Mr. Kemmett also suggested that the Commission meet sometime in the near future to discuss the site.      

The Commission discussed the possibility of scheduling a site walk so as to familiarize Mr. Kirlin with some of the larger properties under the care and custody of the Conservation Commission.  Mr. Kemmett suggested inviting former Chairman, Phil Lindquist.
